Privacy policy

This policy explains how Agathia Devotional Arts handles personal data when you visit agathia.in, send us a request or an enquiry, or become the custodian of an Agathia murti.

Two companies act as data controller, depending on where your order is delivered:

• Russia and Belarus: IE Gorchakov K.S. (OGRNIP 325774600734755), Russian Federation.
• All other countries: SMIN Composite Tech Private Limited (CIN U23109HR2023PTC113080), Gurugram, Haryana, India.

We follow the laws that apply to us and to you, including the EU and UK General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA/CPRA), the Indian Digital Personal Data Protection Act 2023 and Russian Federal Law No. 152-FZ “On Personal Data”.

• A request for a murti: your name, email, phone, country, delivery address, the name to be engraved, and any note you add.
• An enquiry or a message: your name, email, country and what you write to us, by the contact form, by email or on WhatsApp.
• As a custodian: the name registered to your murti and, if you agree on its page, your consent to receive letters from the atelier.

We do not create customer accounts, and we do not collect card details on this site. You pay through a secure link from a payment provider, who handles your card details under their own privacy policy.

• Technical data: IP address, browser, device and operating system.
• Usage data: pages visited and how you reached the site, collected by Google Analytics only if you accept analytics cookies (section 09).

• Payment providers: confirmation that a payment was made. For Russia and Belarus, the Russian bank that processes card payments; for other countries, Razorpay and PayPal.
• Couriers and customs brokers: delivery and customs status of your parcel.

If you are in the European Economic Area or the United Kingdom, we rely on the following legal bases.

• to reply to your request or enquiry and confirm availability, lead time and the final amount;
• to engrave the custodian’s name, prepare, ship and clear your parcel through customs;
• to keep the register of custodians and your murti’s own page;
• to write to you about your order and, only with your consent, to send letters from the atelier;
• to understand how the site is used, only with your consent to analytics cookies;
• to meet tax, accounting and legal obligations and to protect the site from abuse.

We do not send advertising newsletters, we do not sell your data, and we make no automated decisions about you.

• Service providers who work on our behalf: website hosting, email, payment providers, couriers, customs brokers and Google Analytics. They may use your data only to provide their service to us.
• Authorities, where the law requires it.

Personal data of citizens of the Russian Federation is recorded and stored on servers located in the Russian Federation (Yandex), in accordance with Article 18 of Federal Law No. 152-FZ.

For other customers, our service providers may process data outside your country, including in India, the European Union and the United States. Where the law requires it, we rely on appropriate safeguards, such as the European Commission’s Standard Contractual Clauses.

You can ask for access to your data, its correction or erasure, restriction of processing, data portability, and object to processing based on legitimate interests. You can withdraw consent at any time. You can also complain to your data-protection authority.

You can ask what personal information we hold, ask us to delete or correct it, and you will not be treated differently for using these rights. We do not sell or share personal information for advertising.

You can ask for a summary of your data, its correction or erasure, and nominate another person to exercise your rights.

You can request information about how your data is processed, its correction, blocking or deletion, and withdraw your consent at any time.

Write to agathia.store@gmail.com. We answer within 30 days and may ask you to confirm your identity first.

We do not use advertising cookies. On your first visit a banner asks for your choice. You can change it at any time through the Cookie settings link at the bottom of every page, or in your browser settings.

This site is not meant for children under 16 (13 in the United States), and we do not knowingly collect their data. If you think a child has sent us personal data, write to us and we will delete it.

The site uses TLS encryption. Access to customer data is limited to the people in the atelier who need it, with personal passwords. We do not store card details. No system is completely secure; if a breach affects you, we will tell you as the law requires.

Our pages link to WhatsApp, Instagram, Pinterest and payment providers. Their privacy policies apply when you use them.

When we change this policy, we update the date at the top of this page. If the change matters for an order in progress, we will write to you.
